The Privacy Policy applies between:

The User and the Data Controller are individually referred to as "Party" and collectively as "Parties".

Any conditions or clauses contrary to the Privacy Policy will be considered null and void, unless expressly stated by the Data Controller on the Site. 

Definitions 

Terms beginning with a capital letter have the meanings attributed to them below:

  • Privacy Policy : This document defines the respective rights and obligations of the User and the Data Controller regarding the processing of personal data collected from the Site. The Privacy Policy may be updated at any time. Each User should therefore refer to the most recent version of the Privacy Policy, available on the Site. 
  • Site: refers to the website of the Data Controller via the URL address https://templatemarket.fr (or any new URL that replaces and/or is added to this address).  
  • User(s): any natural person who accesses and uses the Site, in particular to consult it, purchase paid Products or Services or subscribe to free Products or Services from the Data Controller, contact the Data Controller, request to receive the Newsletter, etc.      
  • Product(s) or Service(s): refers to each Product or Service offered by the Data Controller and available from the Site, for sale or free of charge upon registration where applicable.
  • Data Controller: refers to the company or corporation identified in the "scope" section in accordance with the definition given by the General Data Protection Regulation (EU) 2016/679 (GDPR), in that it determines the purposes and means of the processing carried out on Personal Data. 
  • Personal data: refers to all personal data relating to the User and allowing him or her to be identified directly or indirectly (e.g. telephone number, email address, first name, last name, IP address, etc.).
  • Processing: refers to all actions carried out by the Data Controller on Personal Data, such as in particular the collection, recording, consultation, use, storage, communication by transmission or dissemination, backup of Users' Personal Data. 

Purpose of the Privacy Policy

This Privacy Policy aims to inform Users of the Site of the rules for the protection of personal data of which they are the holders, which are applicable in the context of the processing of their Personal Data collected from the Site, by the (the) Data Controller in its capacity as Data Controller as well as the rights which they have. 

Acceptance of the Privacy Policy 

Access to and use of the Site by the User constitutes unreserved acceptance of this Privacy Policy. The User therefore declares and acknowledges having read and accepted the Privacy Policy before transmitting any of their Personal Data to the Data Controller. 

Protection of personal data

Throughout the User's access to and use of the Site, the Data Controller may collect Personal Data fairly and lawfully.

Purposes of data collection and processing.

Personal Data is collected and processed by the Data Controller for explicit, specified and lawful purposes, listed below.
Indeed, personal data is mandatory and necessary for: 

  • The sale of Products or Services and the management of orders by the Data Controller. The legal basis is: the performance of the General Terms and Conditions or the contract concluded between the User and the Data Controller.
  • The provision of a free Product or Service offered by the Data Controller. The legal basis is: the consent given by the User to the collection and processing of their Personal Data.
  • The management of deliveries, after-sales service (ASS) for products or services, and customer relations with the user. The legal basis is: the performance of the terms and conditions or the contract concluded between the user and the data controller.
  • Managing a database of prospective and current customers on a waiting list to inform them of new offers (or the reopening of existing ones) and to offer them for purchase. The legal basis is: the consent given by the User to the collection and processing of their Personal Data.
  • Electronic marketing and sales prospecting activities. The legal basis is: the User's consent to the collection and processing of their Personal Data.
  • The creation and management of the User's personal account on the Site or on a third-party electronic platform. The legal basis is: the performance of the Terms and Conditions or the contract concluded between the User and the Data Controller.
  • The use of technical cookies on the User's devices, necessary for the operation of the website (e.g., session cookies, display cookies, cookies for measuring technical performance and usability, analysis of content viewed, etc.). The legal basis is: the performance of the Terms and Conditions or the contract concluded between the User and the Data Controller.
  • The use of cookies on the User's devices is intended to display personalized advertising based on the User's browsing history and profile. The legal basis for this is the User's consent to the collection and processing of their personal data.
  • The use of cookies on the User's devices is intended to measure the audience of the displayed advertisement. The legal basis for this is the User's consent to the collection and processing of their personal data.
  • The use of cookies on the User's devices to deliver advertising based on the User's geolocation. The legal basis is: the User's consent to the collection and processing of their Personal Data.
  • The use of cookies on the User's terminals, to personalize the content of your site based on the sites and applications previously visited by the User: Purpose not pursued.
  • The use of cookies on the User's device allows the User to share certain Site content on social networks or online platforms. The legal basis for this is the User's consent to the collection and processing of their personal data.

Information collected. 

The User expressly acknowledges that their refusal to provide their Personal Data may prevent the proper functioning, provision, access to, and use of the Site, as well as the Products or Services and the commercial and marketing operations to which they have subscribed or which arise from their contractual relationship with the Data Controller. In this case, the Data Controller shall not be held liable by the User. 

The personal data collected is that listed below:

  • Information related to the User's identity: first name, email address, postal address, country of residence, telephone number, social media profile name
  • Information related to the User's professional status: the user's or client's profession, legal information about their company or business (company name, registration number, registered office address, etc.).
  • The User's payment information:
  • Information related to the User's browsing: the browser used, the browsing duration, the operating system used, the language and pages previously viewed, traffic data, data on terminal equipment (PC, smartphone, etc.)
  • Information related to the User's opinion: reviews and testimonials associated with the User's identity, comments associated with the User's identity, the User's photograph, the User's logo or trademark, the User's professional or personal status

Recipients or categories of recipients of Personal Data. 

The Data Controller transmits Personal Data to the following recipients or categories of recipients:

  • The Data Controller's manager, the service provider responsible for the administrative and commercial management and monitoring of Users, the accountant and lawyer for the Data Controller's accounting, financial, and legal management, the software and application publishers used by the Data Controller for its business, the website host, the automated email marketing solution, the online payment solution used on the website, and the online course platform.

The recipients are authorized to process the User's personal data, on behalf of the Data Controller, strictly necessary to achieve the purposes set out in the Privacy Policy. 

The sharing of Personal Data is necessary and mandatory for the proper functioning of the Site, as well as for the provision of Products or Services and commercial and marketing operations to which the user has subscribed or which result from their contractual relationship with the Data Controller. 
The User expressly acknowledges that their refusal to share their Personal Data with recipients may prevent the proper functioning, provision, access to, and use of the Site, Products, and Services. In this case, the Data Controller cannot be held liable by the User. 

Storage and Transfer of Personal Data 

Personal data is stored and transferred outside the European Union and the European Economic Area, to a territory with an adequate level of protection under the GDPR.

Shelf life. 

Personal Data is retained for the entire duration of the provision or access to the Products or Services and/or the User's personal account and then for 60 months after the end of access or provision.

Personal Data is also retained as long as the User does not unsubscribe from the Newsletter and other commercial prospecting and marketing operations. 

Personal data that may be collected by means of cookies is kept for a period not exceeding 25 (twenty-five) months.

The retention period limitations mentioned above do not apply to Personal Data for which the law requires a longer retention period or to Personal Data used as evidence for the proper performance of contractual or legal obligations (e.g., invoices, contracts, etc.). In this case, the Personal Data will be retained for the legally required period. 

Beyond that point, the personal data will be deleted. 

User Rights. 

The User has the right to access, rectify, modify, object to, transfer, and delete their Personal Data, or to restrict its processing, by submitting a request to the Data Protection Officer, whose contact details are provided in the following article. If no Data Protection Officer has been appointed, the User should send their request to: support@templatemarket.fr. or via the dedicated form.

In their request, the User is required to indicate: their name, surname, email and address.

In accordance with current regulations, all requests must be signed and accompanied by a photocopy of an identity document bearing the User's signature.
The Data Controller undertakes to respond to the User within one (1) month of the date of their request. The costs associated with sending and retrieving the data are borne by the User. 
It is noted, however, that in accordance with current regulations, the right to object, to portability or to erasure may not be implemented in the event of legitimate and compelling reasons for maintaining the Processing of data, such as in particular for access, provision and use of Products or Services purchased or subscribed to, as well as the performance of contractual relations between the User and the Data Controller. 
The User also has the right to lodge a complaint with a supervisory authority (the CNIL for France).

Data Protection Officer

The Data Controller has not appointed a Data Protection Officer (DPO).

Miscellaneous provisions

8.1 Force majeure. The Parties shall not be held liable for any failure to perform their obligations resulting from the occurrence of a case of force majeure as defined by law and jurisprudence. 

8.2 Waiver. The failure of either Party to enforce any provision of this Privacy Policy shall not constitute a waiver of that Party's right to enforce such provision in the future.

8.3 Invalidity. In the event of invalidity of any clause of the Privacy Policy, it shall be up to the Parties, or in the event of disagreement, to the court seized, to replace it with a clause of the same scope producing, in the common intention of the Parties, identical legal effects.

8.4 Law & Disputes. The Privacy Policy is subject to French law and the courts of the jurisdiction of the registered office or address of the Data Controller shall have exclusive jurisdiction in the event of any dispute.
